These terms and conditions are governed by and construed in accordance with the laws of Moldova and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

FaceFury.com may revise these terms of service at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

11. Affiliate Program

If you participate in the FaceFury Affiliate Program (including by submitting an application at facefury.com/affiliate), the following additional terms apply to you. They supplement, and do not replace, the rest of these Terms of Service.

11.1 Sole Responsibility

You are solely responsible for everything you do as an affiliate, including the traffic you send, the ad creatives, landing pages, copy, lists, and channels you use to promote FaceFury, the disclosures you make to your audience, and your compliance with all applicable laws, regulations, platform policies, and advertising network rules in every jurisdiction you operate in. We do not pre-approve, monitor, or endorse your campaigns, and your acceptance into the program is not an indication that any specific tactic, channel, or creative is lawful or compliant.

11.2 Prohibited Traffic

You may not, directly or indirectly, send to FaceFury any traffic, leads, or conversions that are fake, fraudulent, incentivized in violation of network rules, generated by bots, scripts, click farms, malware, adware, hijacked sessions, cookie stuffing, iframe stuffing, forced clicks, or any other artificial or deceptive means. You may not misrepresent the FaceFury brand, impersonate FaceFury, run unauthorized paid search on our trademarks, spam, send unsolicited email or SMS, or use any tactic that violates the CAN-SPAM Act, GDPR, TCPA, the laws of any jurisdiction, or the terms of any third-party platform. You may not promote FaceFury to minors or in jurisdictions where doing so is unlawful.

11.3 Forfeiture of Unpaid Earnings

If we determine, in our sole and reasonable discretion, that you have violated any law, regulation, network rule, or any provision of these Terms — or have sent traffic that is fraudulent, artificial, abusive, or otherwise prohibited under §11.2 — you forfeit any and all unpaid commissions, balances, or amounts we are holding for you, and we will not pay them out. We may also reverse, claw back, or offset previously paid amounts attributable to such activity, terminate your account immediately, and pursue any remedies available to us at law or in equity. We are not obligated to provide advance notice of forfeiture.

11.4 Indemnification

You agree to indemnify, defend, and hold harmless FaceFury, its owners, operators, affiliates, employees, contractors, and agents from and against any and all claims, demands, investigations, fines, penalties, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your participation in the Affiliate Program; (b) your traffic, creatives, statements, or omissions; (c) your breach of these Terms or any law, regulation, or third-party right; or (d) any claim by a third party (including users you sent to us, advertising platforms, regulators, or rights holders) connected to your activity.

11.5 No Guarantee, No Employment

Acceptance into the Affiliate Program is at our discretion and may be revoked at any time. You are an independent contractor, not an employee, agent, partner, or joint venturer of FaceFury, and you have no authority to bind FaceFury in any way. Payout rates, payment schedules, caps, and offer availability may change at any time. Nothing in these Terms guarantees you any minimum earnings, traffic acceptance rate, or duration in the program.

11.6 Affiliate Creative & Content Policy

Your ads, landing pages, copy, and any other promotion of FaceFury must accurately describe the Service as a reverse face search of the public, open web, and must comply with our Acceptable Use Policy. In particular, you may not:

• Promote the Service using stalking, harassment, "catch a cheater", "find her/his nudes", revenge, doxxing, or other non-consensual or surveillance angles;
• Claim or imply that FaceFury can find private, hidden, or login/paywall-protected content (e.g. private OnlyFans, dating-app, or "leaked" content), or otherwise overstate what the Service does;
• Target or promote the Service to minors, or use sexual content involving or implying minors;
• Use deceptive, defamatory, or misleading creatives, fake testimonials, fake system messages, or impersonate FaceFury or third parties.

You must make all disclosures required by the FTC and applicable advertising rules, and comply with the platform policies of any network you use. Violations of this Creative & Content Policy are violations of these Terms and may result in removal from the program and forfeiture of unpaid earnings under §11.3.
